Meeting of UNIT Officers with City Officials

The following account of the meeting with the UNIT officers and City Officials was shared with Tech Terrace/UNIT News by Cyd Seideman. Thank you Rambling write up of TT-UNIT officers meeting with City of Lubbock officials and administrators: Met w/Lee Ann Dumbald, Mike Martin, Marjorie Manning, James Mahan and me (Cyd) from TT-UNIT neighborhood – Tom Martin, Lee Ann Dumbald, Dale Holton + two members of police department (one works with Codes) and Stuart Walker of Codes Enforcement City Manager initiated meeting and asked police to give us a play by play on the events of the recent party/assault in our neighborhood as they had them recorded – we all discussed that a bit, and got to the point of the meeting, which evidently was to reassure us that they were 100% in the same corner and determined to strengthen compliance in whatever area they could Not a meeting of angry homeowners – just determined – our position is that we would not leave that meeting without a clear path to action, like we have done so many times – we have resources that we pledge to use to act on the civil side of the law – to strongly influence the actions of tenants and landlords Our stance has never been that we are mad at the city or the police – the police have exact procedures they must follow to ensure my liberty as well as that of someone whom I perceive threatening that in some manner, but we all had to agree that what we laid out early in January as a worst case scenario had occurred – and that we simply had to get our act together as citizens of Lubbock – not as just our neighborhood – this directly impacts Lubbock and the perception of Tech and the city for protection and action and most of all SUPPORT of plain old citizens We agreed that we should stay out of the criminal side – leave that to them – but they were made known that we would be immediately and directly involved with re-writing the codes that we thought could better protect our personal safety and enjoyment of our neighborhoods – which are the R-1 residential zoning codes that are in place but not easily enforced, support for the police when they do enforce, and most of all, a commitment that I will put my faith in that ENFORCEMENT at the judicial level will take place – these cases will NOT be dismissed because they are not easily tried or someone pleads out. Mr. Medina promised that and I believe him. And since I intend to be personally involved in this, I will be able to prove it! The unfortunate realization of all of this is that we don’t live in the same world anymore where you can go out and calm or intimidate a group of drunk students into behaving - they seem like your kids, but nowadays they have not be reared in the same manner – sounds like the old lady talk stuff, but I have three sons who would never dream of cursing at a neighbor even when they were drunk – but that is no longer true. We can’t be nice any more – we have to know that we must take care of such matters civilly – and be ready to do it through knowledge of the system – lease wording, R-1 zoning definition knowledge and communication to new homeowners, willingness to finance legal counsel to help in notification to homeowners and their tenants when codes are broken from parking to blocking sidewalks to disruptive parties, instituting a kind of neighborhood watch for when new back apartments are being built without permits – just awareness of what remedies there are Judicial enforcement was the greatest tool we took from today’s meeting – police will often not ticket when they know the case will just be thrown out – that won’t happen anymore – there will be more meat in the codes that could have helped mediate this before it ever happened – and the feeling of how appalling this incident was from normal citizens who are our mayor, and administrative leaders was good to see – the awareness from them that we have to be finished with talking – they and we are ready to act Living in Tech Terrace–UNIT should be a privilege and honor – not just fun.

  2. Thanks, Cyd, for your comments. I wonder whether it is possible to construct an ordinance in zones around the university that requires live-in homeownership, except for backyard cottages, assuming that the owners live in the main residence. I know that other major universities have such zoning ordinances in the immediately vicinity of the campus.

    The donkey has just begun! The real jack-ass is coming!

    As far as the Sodom and Gomorrah biblical story found in Genesis 11-14 and Chpt. 19, please clarify. If you are going to reference biblical stories please elaborate. I am confused...are you suggesting that we "walk away from our neighborhood", then look back and become salt??

    I am NOT going anywhere! I try not to look back and I am PEPPER not salt!!!

Although I like Aaron's idea about an ordinance to require live-in home ownership in the vicinity of the university, I do not know if it is practical, given the number of rental houses in the area. Does anyone know what percentage of houses in the UNIT area are owner occupied? I would like to see an ordinance against out-of-town ownership of houses in Tech Terrace. I also suggest that owners of rental houses pay a fee (perhaps $500 per year?) for each rental house, with the money collected being used for zoning enforcement, and that owners be required to report who is living in their houses.

    TTU needs to consider whether it has the infrastructure to house 40,000 students. Currently, freshmen must live on campus or with a family member; perhaps that requirement needs to be extended to any student under 21.

  13. the news article cited here called "suspect comes forward" said that a group of angry residents had retained an attorney and were going to bring a civil suit.

    this group meeting with the city officials didn't mention any group action other than talking the matter to death.

    does the UNIT association have actual plans for a suit??

  14. The neighborhood association is just that - an association. We officers and others may talk for the association, but acting in a manner as serious as a lawsuit would require approval of the members. However, we will discuss a fund for legal counsel in zoning matters or whatever format it should be and exactly how we would use the funds - hopefully at the March 25 general meeting. As an opinion only - and I own 5 properties in TT-UNIT besides my own - I have often said that the city ought to designate our neighborhood as some sort of special needs (along with Heart of Lubbock!) and allocate extra resources at times of need - which we could help fund or even volunteer to do. Also, landlords should have to pay extra for this - and that would include me. Cyd Seideman.

  15. Does anyone else see a conflict of interest in Cyd Seideman's (treasurer of the UNIT association board) rental property business and her plans to be involved in writing of new codes as indicated in this quote taken from her letter above:

    "We agreed that we should stay out of the criminal side – leave that to them – but they were made known that we would be immediately and directly involved with re-writing the codes that we thought could better protect our personal safety and enjoyment of our neighborhoods"

    Certainly fighting for a code that restricts the UNIT to owner-occupied properties would be a challenge in her situation. Perhaps she should recuse herself from the process??

  16. I live in the neighborhood and extend my offer yet again to meet with residents about security etc. I am an LPD officer and would like to do my part to help keep our community safe.

  17. To Anonymous - what conflict of interest would there be in being willing to stand by the same codes I would like to see enforced/enhanced. If I am willing to work on it, then I am willing to stand behind it even if it costs me money and/or time or change - because I live here (and have since 1964) and would like to continue to do so. Unlike people who recuse themselves from being man or woman enough to be identified...? Cyd Seideman

    Really? Liggett and Ritter, the attorneys, who are representing the Jacoby (party house ) both live in Tech Terrace. I find it interesting to see where their loyalty lays. They are too consumed with taking money from their clients then they are in taking care of their own neighborhood and setting a precedent! I know Glasheen's office will eat 'em for lunch!!! Times must be tough for Liggett and Ritter!

  20. By the way, Liggett, The Party House invites anyone who wants to party. I have been told to come on over on "the party bus" and I don't even know who they are. They just say come on over and yell out their address to whoever is around! That is why the parties become so big! Why are you acting ignorant! What is your motive? I agree with 'Unbelievable', times must be tough for you!! Maybe your house will get pissed on! Have you ever thought about that??

  21. The legal issues regarding this matter are much more complex than what is being portrayed here. As I understand it, Ted Liggett has been retained because of coverage issues with the insurance company. To put it plainly, it sounded as though the insurance company was trying to weasel out of paying. In a lawsuit, it doesn't do any good to take a judgment against a party if the party doesn't have any money. If there's going to be any true damages awarded, it would be from the insurance company--not the collegian who lives in the house who probably doesn't have a dime to his name. Consequently, if you're wanting to make sure that the injured party in this instance actually gets compensated for her injuries, then having Ted Liggett to represent the house to make sure that the insurance company pays is probably a good thing and not a bad one...like I said the law is a lot more complex than it's being made out to be in this situation.

  22. Agreed. The law is a lot more complex, but Liggett could have turned down this case! He has choices, as we ALL do! Loyalty is something to be proud of!

    Rather than seeking financial damages I think we all just want mutual respect! We want for these kids to treat our neighborhood and their homes as if they were their parent's neighborhood and home!

    What happens is the parents can't afford the mortgage solo. Therefore, they have to rent to as many college kids as they think they can get away with to pay their monthly nut! Which they think is an investment, but when they try to sell they will have LOST money because their house is know a pit! The Jacoby house is an eyesore! The parents and kids treat the house with absolute no respect! Grow up!! Imagine your life one day with children and trying to live in a decent neighborhood in a few years!! Is this how you would want to be treated??? I think not!!!

  23. As a former Tech Terrace resident and forever fan of the neighborhood I hate this has happened. The assault was an absolute wake up call. Further news about this area having the highest incidence of burlaries is distressing. I am proud of the citizens for being proactive. I don't think one can limit a neighborhood to owner occupied. As a Realtor and friend of the area, I think you are all right to be concerned about property values. Just need to keep getting the GOOD news about Tech Terrace out there and remember that bad things can happen anywhere in town. http://activerain.com/blogs/merribee

  24. I like the idea of suing the absentee landlords of the problem houses. Parents from out of town buy these houses for their children, load them up with renters, and then look the other way when trouble starts. If enough of these landlords/parents were sued, it might change the perception that this is a good investment strategy. They wouldn't live next door to houses like this themselves, so it is insulting that they think it is perfectly all right for us to have to put up with them.

    Maybe it is time to get the neighbors together and put an attorney on retainer to do just that.

    I also like the idea of getting the phone numbers of these parents when they move their kids in. Then I can offer to call them before I call the police. I figure that if I'm going to be awake at 2 in the morning because I have to listen to the partying, I figure we can all be awake.

    As for being a "terrorist cult" who "ought to leave those kids alone," my yard has been driven across twice by drunks, my oak tree hit twice, my landscape lights damaged, my windshield broken twice, and the space in front of my house used as a parking space for a "shot bus." I can't count how many times I've been kept awake until 1, 2 or 3 in the morning by parties.

    One of my neighbors opened his front door one night to find two drunken young women urinating on his front porch. Another neighbor woke to find students from the party across the street climbing on top of her house. All of us have had to pick up the trash thrown into our front yards during these drunkfests.

    *We're* the terrorists? Shame on you for believing so.

    This is my home. I have lived in this neighborhood for fifteen years, long before it became known as a place for students to party. These "poor kids" are thugs who are just passing through, not people who have put down roots, as I and my neighbors have. I have history here, and I will not be intimidated into leaving. I have a right to defend the peace and quiet of my neighborhood.

    I realize that the majority of the students are good people, and good, respectful people are always welcome to be my neighbor. Thugs, on the other hand, are not.
